Partner Visas (Subclasses 820/801 and 309/100) – For Spouses and De Facto Partners
The Partner Visa allows spouses or de facto partners of Australian citizens, permanent residents, or eligible New Zealand citizens to live permanently in Australia. The process involves two main stages:
- Temporary Partner Visa (Subclasses 820/309): This visa lets you live in Australia temporarily while your permanent Partner Visa application is being processed.
- Permanent Partner Visa (Subclasses 801/100): This visa grants you permanent residency once your relationship has been assessed as genuine and ongoing.
Eligibility Criteria:
- Spouse Visa: If you are married to an Australian citizen, permanent resident, or eligible New Zealand citizen.
- De Facto Visa: For couples who have lived together in a genuine domestic relationship for at least 12 months (exceptions may apply for compelling circumstances).
You must demonstrate a genuine, ongoing relationship with your partner, a commitment to a shared life, and meet health and character requirements.
Evidence Required:
To support your application, you need to provide evidence of your relationship, including financial, social, and household aspects, as well as proof of mutual commitment.
Prospective Marriage Visa (Subclass 300) – For Couples Planning to Marry
If you are engaged and planning to marry your Australian partner, the Prospective Marriage Visa (Subclass 300) allows you to enter Australia, celebrate your marriage, and begin building your life together.
This temporary visa grants you permission to:
- Live in Australia for up to 9 months to plan and celebrate your marriage.
- Work and study (without government assistance) during your stay.
- Transition to a Partner Visa (subclasses 820/801) after you marry to continue living in Australia as a permanent resident.
Eligibility Criteria:
- You must be engaged to an Australian citizen, permanent resident, or eligible New Zealand citizen.
- You and your partner must have met in person and intend to marry.
- Your partner must sponsor your application.
- You must meet health and character requirements.
Evidence Required:
To support your application, you may need to provide proof of your engagement, communication records, travel history, and a detailed wedding plan.
