Work Visas

Our team at IMMIGROO Legal specialises in assisting Australian employers and skilled professionals with Employer Sponsored Visas, providing reliable pathways to bring talent into Australia. These include the Temporary Skill Shortage Visa (subclass 482), Employer Nomination Scheme (subclass 186), Skilled Employer Sponsored Regional visa (subclass 494), and Training Visa (subclass 407).

 Employer Sponsorship Requirements

To sponsor a skilled worker, an employer must first be approved as a Standard Business Sponsor(SBS) or Temporary Activities Sponsor (TAS) . This process involves meeting certain requirements to demonstrate that the business is actively and lawfully operating in Australia, has a commitment to employing locals, and can support a skilled worker from overseas.

Approved sponsors are responsible for meeting certain obligations to ensure that foreign workers are protected under Australian law. This includes monitoring visa conditions, covering travel costs if the visa holder needs to leave Australia, and adhering to fair work practices. Ensuring compliance with these requirements protects both the employer and the employee, fostering a professional and legally secure work environment.

Streams

The new Skills in Demand Visa (subclass 482) replaces the Temporary Skill Shortage Visa to better align with Australia’s workforce requirements. The SID visa has three distinct streams, tailored to address different areas of labour demand:

1. Specialist Skills Stream

This stream targets highly skilled professionals earning a minimum annual salary of AUD $135,000. It is specifically designed for top-tier roles in specialised fields and does not include trades workers, machinery operators, drivers, or labourers. Applicants under this stream must demonstrate exceptional expertise and qualifications in their field.

2. Core Skills Stream

The Core Skills Stream is focused on occupations listed in the newly introduced Core Skills Occupation List (CSOL). It has a lower salary threshold of AUD $73,150 and addresses roles where Australia has persistent skill shortages. The CSOL comprises 456 occupations, reflecting extensive labour market analysis by Jobs and Skills Australia.

3. Labour Agreement Stream

This stream is available to workers nominated by Australian employers who have entered into a Labour Agreement with the Australian Government. It supports industries with specific workforce requirements and offers a flexible pathway for skilled migration tailored to employer needs.

Key Features of the SID Visa

Work Experience Requirements: Applicants need one year of full-time work experience in their relevant occupation within the last five years (reduced from the previous two-year requirement).

Pathways to Permanent Residency: SID visa holders can transition to permanent residency through the Employer Nomination Scheme (subclass 186) visa.

Salary Benchmarks: Each stream has its own minimum salary thresholds, ensuring alignment with Australian wage standards.

English Language Requirement

To be eligible for a 482 visa, applicants must meet the English language requirements, which generally involve proving functional English through tests (IELTS 5 overall). Exemptions may apply in cases where English has been the medium of instruction or the primary language in the applicant’s home country.

Age

There is no age limit for 482 visa

 Additional Work Visa Pathways

At IMMIGROO, we also support applicants and employers in navigating alternative pathways like the Regional Sponsored Migration Scheme (subclass 494), ideal for work in designated regional areas, and the Training Visa (subclass 407) for applicants seeking skills development and training in their field.

TRAINING VISA subclass 407

The Training (subclass 407) Visa allows individuals to develop their skills and gain practical experience in Australia through structured workplace-based training. Training  visa allows individuals to train in Australia for up to two years, helping them enhance their skills in a structured, hands-on setting with an Australian organisation.

 Salary

There is no minimum salary requirements for a 407 visa, so it may be a sound alternative to subclass 482 visa with its Temporary Skilled Migration Income Threshold (TSMIT) or the average market salary rate (ASMR).

 English

At least Functional English (IELTS 4.5, PTE Academic at least 30)

Subclass 407 visa is designed for applicants seeking professional or occupational development and involves three main pathways:

  1. Occupational Training for Registration: For individuals needing training to obtain registration, membership, or licensing in their field, either in Australia or abroad.
  2. Occupational Training to Improve Skills: For those who require structured training to enhance their skills in their current occupation, area of tertiary study, or expertise.
  3. Occupational Training for Capacity Building Overseas: Available to support training for overseas professionals, government officials, or individuals sponsored under overseas aid programs, providing workplace experience that contributes to organisational development.

Application Process

  1. Sponsorship: The Australian business or organisation must be approved as a Temporary Activities Sponsor, demonstrating legal operation and commitment to training Australians where possible.
  2. Nomination: The sponsor nominates the specific training program, detailing the training goals and confirming that local candidates cannot meet the training requirements.
  3. Visa Application: The applicant must meet skill, English language, health, and character requirements and show their role aligns with one of the three pathways.
